Cell Site Analysis in 2015

At the end of last year we wrote that timescales were getting tighter on cell site analysis cases and that we could only see this continuing. This has definitely been the case in 2015 where a large majority of the cases on which we are instructed were all urgent. Cell site analysis is a complex matter and experts need to be engaged at the earliest possible opportunity which we know is not always possible.

We are often now instructed after a trial has started. This can be down to a number of factors such as late service by the prosecution. The defence team can then run into problems if the LAA delay matters when they want additional quotes, or when call data records are served in formats other than their original state.

Our cell site analysis experts have also had to turn away a significant number of instructions due to conflicts between defendants. We are often called months prior to a trial by solicitors and Counsel who want to make sure they can secure a particular one of our cell site analysis experts to conduct a multi handed trial they have coming up. This is normally when they have been on the receiving end of having to instruct a different cell site experts on a previous case where a co-defendant had instructed us first.

In these particular cases we will always recommend other suitably qualified and experienced cell site experts to conduct the work where we cannot.

We have worked on hundreds of cell site analysis cases over the past 12 months, both prosecution and defence. Some very small cases which can be sorted out in a few hours with a desktop exercise and some huge cases which have needed the whole team to work on them for a number of weeks.

This year our cell site experts have been invited to give talks and training at Criminal Cases Review Commission, Sheffield University and at the United against Injustice Miscarriage of Justice Day. This is as well as our usual trips up and down the country to deliver CPD training at chambers.
