How to introduce Defence Cell Site Analysis Evidence

A few years ago it was very rare to receive a phone call from the defence team asking if cell site analysis would help their case when the prosecution had not introduced this particular type of evidence.

Now it is almost an everyday occurrence to receive this type of enquiry. Although cell site analysis is conducted by the prosecution in the majority of murders, attempted murder, drugs, conspiracies and the like, as well as some burglaries and other crimes, we are asked to conduct cell site analysis independently on other types of cases such as harassment.

There are a few problems with conducting independent cell site analysis, the initial one being the call data records, or the lack of them to be precise.

If the prosecution have not produced cell site analysis evidence in relation to your client, then you only have the last 12 months of call data available from the network provider. Unless of course, it is listed in the unused evidence and can be obtained from CPS.

Once it has been established that the call data records still exist you then need to go about obtaining them. A court order is the usual way to obtain the call data records as this will give the expert the incoming and outgoing call data which he will then use to conduct cell site analysis.

A good expert should be able to provide you with all wording needed to request your court order so that all required information is obtained within the order. They should also be able to provide you with a relevant contact at the particular network provider along with an address at which to serve the court order.

Once your cell site analysis expert has received the call data records they will be able to provide you with a quote if they have not already done so. In a number of cases though we would not issue a quote, as once the data is reviewed then it may become apparent that cell site analysis would not be of use to the case and data may not exist for the relevant time period.
